Terms of Payment and Delivery

1. Scope

Any delivery, service and offer shall be provided exclusively based on these Terms of Payment and Delivery. These Terms shall be deemed accepted upon receipt of the goods or services at the latest. Deviations from these Terms shall be effective only if confirmed in writing by the Seller.

2. Prices

The Prices are ex works, exclusive of packing, uninsured, as a rule. All Prices are subject to confirmation and are understood including legal VAT. 

3. Shipping

Deliveries shall be made by forwarding agent or parcel service, according to the Seller’s preference. The Seller shall be entitled to make partial deliveries or provide partial services. Shop and catalogue orders shall attract a flat-rate shipping fee for each order, depending on its value, in line with the following scale: up to EUR 500 = EUR 10; up to EUR 1,000 = EUR 15; more than EUR 1,000 = EUR 20. 
Any freight forwarding expenses that are incurred shall be charged separately. These flat-rate fees do not apply to repair work and International deliveries; charges are calculated on the basis of the actual work involved.

4. Reservation of Ownership

The Goods shall remain the Seller's property until paid in full. The Buyer is not entitled to re-sell the goods to third persons without the Seller's consent.

5. Warranty

We shall grant the usual warranty of 2 years for defects, if any, provided that the defect will be reported within 10 days upon delivery. Defects which cannot be detected within this time even with careful inspection shall be reported in writing to the Seller immediately after they have been detected. The right for subsequent performance shall become void if the Buyer has carried out repairs himself or used non-original spare parts. The warranty shall not include galvanic finishes and wearing parts. Defects do not discharge the Buyer from his duty to pay. The Seller shall repair the defective part or supply a replacement part if the claim is justified and the defect has been notified in due time.




 
6. Payment

All invoices shall be due for payment immediately on receipt without any deductions, provided that no other conditions of payment have been agreed on the invoice. 
Payments must be made free of any charges. Invoices for repair work up to a value of EUR 250.00 shall be due for payment immediately (when the repair work has been handed over to the customer).

7. Consignments on Approval/Sample Consignments

We shall charge a fee of EUR 52 (including 19% German VAT) for dispatching consignments on approval and samples. If this procedure leads to further business, the amount will be credited on the invoice. Items that are not purchased must be properly packaged in a perfect condition and returned to us free of charge. Any item returned without carriage paid shall not be accepted. The customer shall bear the liability for any damage that occurs. 


8. Right of Withdrawal

You have the right to withdraw from this agreement within fourteen days without the need to specify the reasons for doing so.

The withdrawal period is fourteen days from the date on which you or a third party appointed by you, which is not the carrier, took possession of the goods. 

In order to exercise your right of withdrawal, you must inform us of your decision to cancel this agreement with an absolutely clear declaration (e.g. a letter sent by post, a fax or e-mail) and send it to:

In order to meet the withdrawal deadline, it is sufficient to send the message about exercising your right of withdrawal before the expiry of the withdrawal period.



 
Consequences of withdrawal

If you cancel this agreement, we have to immediately reimburse all the payments, which we have received from you, including the delivery costs (with the exception of the additional costs, which are the result of you selecting a different kind of delivery than the cheapest standard delivery service, which we offered) and do so at the latest within fourteen days from the date on which we received the message about your withdrawal from this agreement. To make this repayment, we shall use the same form of payment, which you used for the original transaction, unless some other specific agreement was made with you; fees will not be charged for this repayment under any circumstances. We may refuse to make repayment until we have received the goods again or until you have provided the evidence that you have returned the goods, whichever takes place first. 

You must immediately send back or hand over the goods to us – at the latest within fourteen days from the date on which you inform us of your withdrawal from this agreement. The deadline has been met if you dispatch the goods before the expiry of the deadline of fourteen days.

You shall be responsible for the direct costs of returning the goods.  

You only have to pay for any loss in the value of the goods, if this loss in value can be attributed to any unnecessary practices that you have used to check the quality, features and functions of the goods.

9. Scope of Law

These Terms of Payment and Delivery and all legal relations between the Buyer and the Seller shall be subject to the applicable law. The place of performance shall be Markneukirchen / Vogtland and the legal venue shall be Plauen.
